Terms of Purchase.

General

This website is operated by Gal Disegni (referred to as "the artist," "we," or "the site") and is used to sell fine art prints, original artwork, custom commissioned work, and art workshops.

These terms apply equally to all genders and are written in one grammatical form for convenience only. They apply to any use of the site and any purchase made through it, and constitute a binding agreement between you and us.

Making a purchase on the site confirms that you have read and agree to these terms, the cancellations and returns policy, and the privacy policy.

Who May Purchase

Any person aged 18 or older, with the legal capacity to enter into a contract, and holding a valid payment method or bank account in their own name, may purchase on the site.

A minor under 18 may only purchase with the explicit prior consent of a parent or legal guardian. A purchase made by a minor constitutes a declaration that such consent was obtained.

You must provide complete and accurate details. Incorrect details may prevent delivery of your order, and we are not responsible for any delay or failure to deliver resulting from an incorrect address or contact details provided to us.

Products, Images, and Dimensions

Fine art prints are reproductions of original artwork, manufactured by a professional printing supplier after the order is placed. Original artworks are one-of-a-kind pieces, and commissioned work is created specially for the customer.

We have made every effort to display the artwork as accurately as possible, but there may be differences in hue, brightness, and saturation between the on-screen display and the actual print, due to differences between screens, calibration, and printing materials. Such a reasonable color difference is not considered a product defect.

The dimensions shown on the site are the dimensions of the print itself, in centimeters (or inches in foreign-currency display), and do not include a mat or frame unless the product is explicitly stated to be framed.

The stock of original artworks is inherently limited. If a piece has been sold and the site was not updated in time, we will notify you immediately and refund the full amount.

Pricing and Payment

All prices on the site are stated in New Israeli Shekels (₪). A price shown in dollars, if available, is for illustration only; the actual charge is made in shekels.

The business operates as a VAT-exempt dealer ("osek patur") under Israeli law. Accordingly, no VAT is charged on transactions, the prices shown on the site are final and do not include a VAT component, and a receipt (not a tax invoice) will be issued for the purchase.

Shipping cost is calculated separately based on the print type, size, and quantity, and is shown in full on the cart page before payment is confirmed. The final amount due, including shipping, is displayed before you confirm the order.

Payment is made in one of two ways: online credit card payment through a licensed payment processor, or bank transfer to the account details shown on the cart page. Credit card details are submitted directly to the payment processor and are not stored by us.

An order is considered confirmed only once actual payment confirmation is received. Until payment is confirmed, the item is not reserved for you and production does not begin.

In the event of a clear clerical error in a price shown on the site, we will not be bound by the incorrect price. We will contact you, present the correct price, and you may choose to proceed with the transaction or cancel it and receive a full refund.

Delivery and Shipping

Production begins once payment is confirmed. Total delivery time consists of production time and shipping time, both counted in business days (Sunday-Thursday, excluding Fridays, Saturdays, and holiday eves and holidays).

Different products are produced in different timeframes - a paper print is faster than a framed print or stretched canvas. Original artworks are shipped after special packaging, and commissioned work is subject to a timeline agreed with you separately in advance.

Shipping is made to the address you entered when placing the order. Please make sure the address is complete and accurate, including apartment number, floor, and any other detail needed to locate it.

Delays beyond our control may occur - carrier backlogs, customs delays on international shipments, strikes, extreme weather, or force majeure events. We will update you of any material delay we become aware of.

If your order is significantly delayed beyond the time you were given and we are unable to deliver it, you may cancel it and receive a full refund, including any shipping fees paid.

• Production time: 2-5 business days for paper prints; 3-7 business days for framed prints and stretched canvas.
• Shipping time within Israel: 5-12 business days from the completion of production.
• Shipping outside Israel: 10-21 business days from the completion of production, subject to customs procedures at the destination.
• Taxes and customs at destination: For shipments outside Israel, import taxes, customs duties, and local fees - if applicable - are the responsibility of the customer and are not included in the price.

Cancellation, Returns, and Exchanges

The right of cancellation, how to exercise it, cancellation fees, refund timelines, and the special rules for original artworks, commissioned work, and workshops are detailed in full in the Cancellations & Returns Policy, which forms an integral part of these terms.

In brief: fine art prints may be cancelled within 14 days of receiving the product; cancellation fees will not exceed 5% of the transaction price or 100 ₪, whichever is lower; and a refund will be issued within 14 days of receiving the cancellation notice. Original artworks and commissioned work are subject to separate rules.

Warranty and After-Sales Service

We are responsible for ensuring that the product delivered is sound, matches its description on the site, and is free of manufacturing and printing defects.

If the item arrives damaged, broken, or does not match what was ordered, please contact us within 48 hours of receiving the shipment, with photos of the item and its packaging. We will arrange a replacement or a full refund, at our expense, as applicable.

The warranty does not cover damage occurring after delivery as a result of improper use, handling, or storage, including: fading from direct and prolonged sun exposure, moisture or water damage, creasing, scratches, damage caused during self-framing or hanging, and natural wear over time.

Artwork on paper and canvas is delicate. We recommend hanging it away from direct sunlight and sources of moisture, and having it framed by a professional framer with UV-protective glass.

Art Workshops

Registration for a workshop is by prior arrangement and subject to space availability. Workshop details - date, duration, location, number of participants, and included materials - are provided before registration.

We may change the date or location of a workshop, or cancel it, in the event of insufficient registrations or circumstances beyond our control. In such a case we will offer an alternative date, and if it doesn't suit you, a full refund will be given.

Participation in a workshop is the participant's own responsibility. Please inform us in advance of any sensitivity to art materials (paints, solvents, charcoal dust) or a relevant health limitation. Participants under 18 - subject to the workshop's terms and a parent's consent.

Intellectual Property

All artwork, images, photographs, videos, text, design, the artist's name, logo, and signature appearing on the site are protected by copyright and intellectual property rights. All rights reserved.

Purchasing a print or an original artwork grants ownership of the physical copy purchased only, and does not transfer copyright, or the right to reproduce, publish, commercialize, or create derivative works.

The site expressly reserves its rights regarding data mining and the use of its content for training or developing artificial intelligence systems. Full details, including the explicit reservation against AI training, appear in the Copyright Policy.

Privacy and Data Security

The use of details submitted on the site, the identity of recipients of that information, retention periods, and your rights to review, correct, or delete it are detailed in the Privacy Policy, which forms an integral part of these terms.

Online payment is processed in the secure environment of a licensed payment processor. Credit card details never pass through the site's servers and are not stored by us at any stage.

Limitation of Liability and Force Majeure

We make an effort to keep the site functional, available, and up to date, but we do not guarantee that it will operate without interruptions or faults. We are not liable for damage caused by a technical malfunction, a service outage of an external provider, or access to the site.

Our total liability in connection with any order will not, in any case, exceed the amount actually paid for that order.

We will not be liable for any failure or delay in fulfilling our obligations resulting from circumstances beyond our reasonable control, including war, a state of emergency, strikes, natural disaster, pandemic, infrastructure failure, or an order by a competent authority.

Links to external websites and social networks are provided for your convenience only. We are not responsible for the content, availability, or privacy policy of sites not under our control.

For any question, inquiry, or complaint regarding an order, a product, or these terms, you may contact us by email, phone, or WhatsApp using the details at the top of this page. We will strive to handle every inquiry within the stated response time.

We prefer to resolve any dispute through direct, fair conversation. We'd be glad if you reached out to us before pursuing any other process.

Governing Law and Jurisdiction

These terms and any transaction made on the site are governed exclusively by the laws of the State of Israel.

Exclusive jurisdiction over any matter arising from these terms or from use of the site lies with the competent courts of Israel, in accordance with the law. This does not derogate from a consumer's right to apply to the forum authorized under the Consumer Protection Law.

Changes to These Terms

We may update these terms from time to time. The binding version is the one published on the site at the time the order is placed, and the date of the last update appears at the top of the page.

A change to these terms will not apply retroactively to orders already placed and confirmed.
